Terms and Conditions
 

All sales by Frizelle Cakes are subject to the following terms and conditions. Nothing contained within these terms and conditions affects your statutory rights as a consumer.  

 

Consultations
Consultations are by appointment only.  Appointments can be made by visiting our contact page and submitting out the online form or by emailing cakes@frizellecakes.com. We do not charge for this service.

 

Appointments last for approximately 30 minutes and are for a maximum of three persons unless otherwise agreed.  You may request to taste up to three cakes from our 'flavours' menu at your consultation. Cake tasters will be subject to availability (although we'll always try to offer the flavours requested) and unfortunately we do not offer tasters of fruit cakes. These three cake tasters are complementary. Should you request additional cake tasters a charge may be incurred.

 

Quotations:  The price stated on your quotation is valid for a period of three months. The terms and conditions of business are supplied on the quotation document. We are happy to redesign and re-quote  until you are happy, just let us know what you would like to change.

 

Sketches: All sketched produced by Frizelle Cakes are subject to copyright and are produced for the client in good faith.

 

Placing an order and paying your deposit.
To book your wedding cake a £100 deposit is required. Placing a booking is agreement from the customer to accept the terms and conditions of business as stated in this document and on www.frizellecakes.com. The booking deposit is non refundable and non transferrable  should you cancel your order for any reason. Your order is deemed as accepted by Frizelle Cakes only when you receive confirmation in writing that your deposit has been received and your order accepted.

 

Payments
Payments can be made by: BACs, Cash, Cheque or Paypal. Paypal payments will incur a processing fee

 

Final Payments
Three weeks prior to your event you will receive an invoice for the remainder. The balance must be cleared 2 weeks before the collection or delivery of your cake or your order will be void. In the event of late payment,  completion of your order cannot be guaranteed and may be subject to additional fees.

 

Alterations
Your cake is important to us and we want you to be happy. We are happy to make alterations to your cake design and order up to 4 weeks prior to your event date, subject to availability. Please be aware that this may affect the balance due and your invoice will be adjusted accordingly. We are not obliged to accept alterations that will reduce the total price of your order by more than 25%. If you have any questions or concerns regarding your cake order, please get in touch.

 

Delivery and set-up
Delivery to and set up at venues within 10 miles of Chichester is included in your order and the delivery address will be stated on your order.  All other delivery charges can be provided on request. We will liaise with your venue or event coordinator to arrange delivery and we aim to deliver at the best possible time. Delivery times are however subject to availability. It is the Customer's responsibility to ensure that Frizelle Cakes has been given the correct delivery information. If we attempt delivery as agreed and delivery is not possible your order will be returned to Frizelle Cakes and we will contact you to arrange alternative delivery or collection, for which an additional fee may be charged.

 

We want your cake to be displayed at its best and we are happy to sprinkle petals, locate knives, straighten tablecloths, tie ribbons etc. It is the customer's responsibility to ensure that you've provided us with the set-up details and arrangements made with the venue for the location and display of your cake.  Please ensure that the cake location is level, stable and strong enough to hold your cake (which can be surprisingly heavy!).

 

We strive to leave everything looking perfect and photographs of final set-up will always be taken.

 

Occasionally we are faced with severe weather conditions, public unrest, or other unexpected events out with our control. You can be assured that we will always do our best to deliver as pre-arranged, however Frizelle Cakes cannot be held liable if delivery is late or is not possible due to factors beyond our control. Wedding insurance may give you peace of mind against such occasions.

 

Accidental Damage                                                                                
Please be aware that cakes are extremely fragile and difficult to transport. We will we take upmost care of your cake and we are experienced in all aspects of cake delivery however unfortunately accidents can happen. In these unfortunate circumstances Frizelle Cakes will make all reasonable efforts to repair your cake. Any refunds will be at the discretion of Frizelle Cakes. We cannot be held responsible for any damage incurred to the cake once it has been left in the care of your venue. To reduce the risk of such damage we advise t hat cakes are not moved once they have been set up.

 

Collection
Your order may be collected from Frizelle Cakes at a pre-arranged time. We recommend picking up your cake in a vehicle, tiered cakes can be very heavy. We do not take any responsibility for any damage that may occur to the cake once it has left Frizelle Cakes.

 

Cancellation
As your booking is bespoke, and certain components of your cake may be ordered or made months in advance, the following terms apply if the order is cancelled by the customer.

* More than 14 days prior to the delivery date:  your deposit will be retained by Frizelle Cakes

* Less than 14 days prior to your delivery date: Frizelle Cakes we will refund 25% of the full amount paid.

 

Any other refunds are made at our discretion only.

Any payments made including deposits are non transferrable should you cancel your booking

 

In the unlikely event that Frizelle Cakes needs to cancel your order we will return to you any monies paid and will aim to find a replacement cake maker for you. We cannot guarantee the price, or availability of  an alternative cake maker.

 

Stand Hire
We hire many different stands on which to display your cake. Please ask for more information. There may be a charge for your cake stand, and we will always  ask for a refundable deposit (value dependent on the cake stand in question). This deposit is payable with your final cake payment. The hire charge. We ask that all stands are returned to us by prior arrangement a maximum of 5 days after the event. This is because we may need it for another client. Deposits are refunded within 48 hours of a return by arrangement. If you choose to return the stand by courier or postal order you are liable for the cake stand until it has been returned to, and inspected by Frizelle Cakes. We may be able to collect your cake stand, subject to a mileage fee.

 

If stands are not returned, returned damaged or with pieces missing you may be charged or in some circumstances you may lose your full deposit. If your stand is returned late we reserve the right to retain a percentage of your deposit.  In these instances any refund is at our discretion.

 

Flowers and in-edible items
At the request of the client, cakes sometimes contain in-edible items such as broaches, ribbons, flowers , feathers etc. These items must be removed before serving and we accept no responsibility for any harm these might cause.

 

We can provide flowers to decorate your cake, or we can liaise directly with your florist. Be aware that some flowers are not suitable for cake decoration, or may be toxic if eaten and all foliage must be removed before serving. Any contamination to your cake is not our responsibility.

 

Dietary Requirements.
We are happy to offer suggestions on cakes that are ‘free from...'

Eggs, nuts, alcohol and wheat are all common requests. Nuts are frequently used in our kitchen however not all of our cakes contain them. Please be aware. We cannot be held responsible for any ingredient contaminated at source, or any harm that may occur. If you are unsure, please just ask.

 

Best Before Date

All cakes are baked to ensure that they are fresh on the day of delivery, and are best consumed on the day, or within a few days. If stored correctly the cakes may be edible for longer than this. Our cakes do not include preservatives and therefore do not have the extended shelf life of some supermarket cakes.

 

Storage; Please ensure that your cakes are stored in a cool, dry place out of direct sunlight. Please do not refrigerate your cakes, sugarpaste (fondant) icing will soften and condensation will appear, colours may bleed and sugar decorations may wilt.

 

Comments and complaints.
We want you to be happy with your cake and strive to achieve customer satisfaction. In the event that you are not happy with your cake please speak to us at the time of delivery and we will try to rectify any problems. If you are not available and you have not nominated anyone to accept delivery, the staff at your venue will be responsible for checking the cake's condition.

 

After delivery if you have comments or complaints please get in touch as soon as possible. Concerns should be made in writing within one week and evidence of the faults should be provided.  A refund will only be considered if the cake is returned to Frizelle Cakes within 24 hours in order that we may assess the nature of the complaint.  Depending upon the fault with the cake, a maximum refund for the value of the cake may be made. Further compensation is not available.

 

Copyright and photography.
All cakes provided by Frizelle Cakes are subject to copyright however photographs can be taken for personal use. Frizelle Cakes reserves the right to use photographs of your cake for marketing and advertising purposed. Your cake will not be displayed on any website or social media until it will have been seen by your guests. If you would like to submit photos of your cake to any magazines, blogs or similar please let us know. We are usually delighted to be included!

 

Limit of liability.
Frizelle Cakes does not accept liability and shall not be liable for non-completion of any order or for any delays arising as a result of: Strikes, riots or lock outs affecting any trade with which Frizelle Cakes is concerned, Exceptionally adverse weather conditions. Loss, damage or cancellation due to fires, floods of any other cause beyond our  reasonable control.

 

The liability of Frizelle Cakes  in respect of all claims arising under any contract should be limited to the amounts of the price paid  to The Company under such order.

 

Frizelle Cakes shall not be liable under any circumstances for any consequential loss or damage whatsoever, caused by Frizelle Cakes' negligence, breach of contract, or any other cause whatsoever.

 

For your peace of mind Frizelle Cakes is a fully registered and inspected food premises. We are also fully insured.
